N.C. Utilities Commission Approves Utilities Request to Withdraw Motion
In a N.C. Utilities Commission (NCUC) order (opens as .pdf) today, the NCUC formally agreed to a request by the state’s electric utilities to withdraw their motion to delay and modify requirements relating to the use of poultry waste.
As we told you in December, this is an important development for Fibrowatt. This action confirms that the utilities must comply with the enacted requirements set forth in Senate Bill 3, North Carolina’s landmark renewable energy and efficiency legislation passed in 2007.
While this is an important step forward, there remains one last item that needs to be addressed, how the state aggregate requirements of SB3 for poultry waste will be apportioned amongst the obligated utilities. Based on this motion, the Commission expressed agreement with the majority position on apportionment but recognized that not all obligated parties had yet agreed to this approach. We hope this can be addressed quickly as both Fibrowatt and the utilities need to act soon so as to meet the implementation schedule of this Bill.
